Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the PrizeTrail mobile application ("App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and PrizeTrail ("Company," "we," "our," or "us").

2. Description of Service

PrizeTrail is a fitness tracking application that allows users to:

• Track daily steps and physical activity using HealthKit integration
• Earn virtual step points based on activity. Step points are then used to win credits
• Participate in daily, weekly, and monthly challenges
• Complete quests for additional rewards
• Compete in multiplayer tournaments against other users
• View and compete on leaderboards
• Maintain daily streaks for bonus rewards
• Redeem earned credits for rewards through our reward system
• Access premium features through subscription plans
• Create user profiles with customizable privacy settings

3. Eligibility and Account Requirements

3.1 Age Requirements

You must be at least 18 years of age to use PrizeTrail.

3.2 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must immediately notify us of any unauthorized use of your account
• One account per person; multiple accounts are prohibited

3.3 User Profiles

• You may create a public or private profile
• Public profiles display your display name, achievements, and statistics on leaderboards and to other users
• Private profiles hide your detailed statistics from other users while still allowing participation in leaderboards and tournaments
• You are responsible for the content displayed on your profile, including your display name
• Display names must not contain offensive, inappropriate, or misleading content
• We reserve the right to remove or modify display names that violate these Terms

3.4 Account Termination

We reserve the right to remove step points and/or credits, and suspend or terminate accounts that violate these Terms or engage in fraudulent activity. Terminated accounts permanently lose all step points and credits held within them.

4. Health and Safety Disclaimers

4.1 Not Medical Advice

PrizeTrail is for general fitness tracking purposes only and does not provide medical advice, diagnosis, or treatment. Always consult with healthcare professionals before beginning any exercise program.

4.2 Use at Your Own Risk

Physical activity carries inherent risks. You assume all responsibility for your health and safety while using the App. Listen to your body and your doctor, and exercise within your limits.

4.3 Device Accuracy

Step counts and activity measurements are estimates and may not be perfectly accurate. Do not rely solely on the App for critical health decisions.

4.4 Medical Conditions

If you have any medical conditions, injuries, or concerns, consult your healthcare provider before using PrizeTrail or increasing your physical activity.

5. Step Points, Credits, and Reward System

5.1 Earning Step Points

Step Points are a virtual currency earned through:

• Daily step activity. 100 steps earns you a step point (Regular*)
• Buying step point packages in the in app store. This is not required to earn step points but may speed up the process of earning step points (Bonus*)
• Redemption of promotional codes that give step points (Bonus*)
• Watching advertisements through the "Free SP" feature (Bonus*)
• Winning tournaments (Bonus*)
• Completing quests (Bonus*)
• Discovering and claiming easter eggs hidden within the app (Bonus*)

*There are two types of step points: Regular and Bonus.

• Regular step points come from physical activity such as walking. These step points reset back to 0 every night at midnight.
• Bonus step points are earned from purchasing step point packages, promo codes, watching ads, tournament winnings, quest rewards, easter eggs, and other non-physical activity methods. These do not reset, you keep these until you spend them.

5.2 Earning Credits

Credits are virtual currency earned through:

• Using step points to spin the prize wheel
• Completing challenges and achievements
• Bonus activities and promotional codes

5.3 Step Points and Credit Properties

• Step Points and Credits are the name of the in-game currencies in the PrizeTrail app
• Step Points and Credits have no real-world monetary value
• Step Points and Credits cannot be transferred between accounts
• Step Points and Credits cannot be sold, traded, or exchanged for cash
• Step Points and Credits balances are tied to your account and non-transferable
• Step Points and Credits are subject to storage limits which vary by subscription tier

5.4 Step Points and Credit Expiration

• Step Points earned from physical activity expire at midnight and reset to 0. Credits and Step Points earned from non-physical activity (promo codes, purchases, ads, tournaments, quests, easter eggs, etc.) do not expire or reset while your account remains active.
• Step Points and Credits may be forfeited if your account is suspended or terminated for Terms violations
• Inactive accounts (no login for 2+ years) may lose accumulated Step Points and Credits
• Step Points and Credits may be forfeited if your account is flagged for fraudulent activity

5.5 Reward Redemption

• Rewards are subject to availability and may change without notice
• Reward fulfillment typically occurs within 24 hours from purchase. This fulfillment speed may vary
• We reserve the right to substitute equivalent rewards if items become unavailable
• Shipping is paid for by PrizeTrail, as such expect 7-21 days for shipped products to arrive. This is just an estimate and can be shorter or longer.

5.6 Fraud Prevention

• Manipulating step counts, using automated systems, or exploiting glitches is prohibited
• Accounts engaging in fraudulent activity will be terminated and credits forfeited
• We employ detection systems to identify abnormal activity patterns
• Multiple device usage to artificially inflate step counts is not permitted
• If a user has an Apple Watch and iPhone, and uses both for step tracking, that is allowed as long as they are not pairing the watch with various iPhones. At that point it becomes fraudulent.
• Exploiting tournament, quest, or leaderboard mechanics through fraudulent means is prohibited

5.7 Free vs. Premium Rewards

• Free users have access to select reward options
• Premium subscribers have access to the full reward catalog
• Reward availability is subject to change. PrizeTrail reserves the right to cancel orders at our sole discretion.

5.8 Promotional Step Points and Credits

• In certain cases, bonus step points or credits from promotions may have special terms or expiration dates
• Promotional step points and credits cannot be combined with certain offers unless specified
• We reserve the right to modify or cancel promotions at any time
• Periodic promotions may offer increased step point earning rates through higher multipliers for limited time periods
• Promotional multipliers are applied at our discretion and may vary in duration and value

5.9 Easter Eggs

• Easter eggs are hidden features within the app that reward step points when discovered and claimed
• Easter egg rewards are one-time claims per user
• We reserve the right to add, remove, or modify easter eggs at any time
• Easter egg rewards may vary and are not guaranteed

6. Tournaments, Quests, Streaks, and Leaderboards

6.1 Multiplayer Tournaments

• Tournaments are competitive events where users compete based on step counts during a defined time period
• Tournament entry may require a step point entry fee
• Tournament prizes are distributed to winners based on final rankings
• Tournament results are final and determined by our systems
• We reserve the right to disqualify participants who engage in fraudulent activity
• Tournament entry fees are non-refundable once the tournament begins, except as described below
• Users may leave a tournament before it starts to receive a refund of their entry fee
• Tournament statistics are tracked and displayed on user profiles (subject to privacy settings)
• We reserve the right to cancel, modify, or suspend tournaments at any time

6.2 Quests

• Quests are multi-day step challenges with progressive milestones
• Quest progress is tracked based on steps taken during the quest period
• Quest rewards are earned upon reaching specified milestones
• Only one quest may be active at a time
• Quest availability, requirements, and rewards may change at our discretion
• Incomplete quests do not carry over; progress resets when a quest expires

6.3 Daily Streaks

• Daily streaks track consecutive days of meeting your step goal
• Streak rewards are earned at specified milestones
• Missing a day resets your streak to zero
• Streak bonuses and rewards may vary and are subject to change
• Streaks are calculated based on your local timezone settings

6.4 Leaderboards

• Leaderboards display user rankings based on various metrics including daily steps, monthly steps, and tournament wins
• Leaderboard participation requires a valid display name
• Your display name and score are visible to other users on leaderboards
• Additional profile information visibility depends on your privacy settings
• We reserve the right to remove users from leaderboards who violate these Terms
• Leaderboard rankings are updated periodically and may not reflect real-time data
• We reserve the right to reset leaderboards at regular intervals (daily, weekly, monthly, etc.)

7. Subscription Terms

7.1 Premium Subscriptions

Premium subscriptions provide enhanced features including:

• Unlimited daily spins
• 2x step point multiplier (2 points per 100 steps)
• 1000 step points can be earned a day from walking
• Access to ALL rewards (up to $100 gift cards)
• Ad-free experience
• Advanced analytics (daily, weekly, monthly, yearly) including step history
• Custom step goals (up to 300,000 steps)
• Challenges with higher rewards
• Early access to new features
• Unlimited credit storage
• Watch App - Premium Features including Tournaments

7.2 Billing and Payments

• Subscriptions are billed through Apple App Store or Google Play Store
• Billing occurs automatically unless cancelled before renewal
• Prices are subject to change with advance notice
• No refunds for partial subscription periods

7.3 Subscription Terms

We offer the following subscriptions for premium service:

• Cancel subscriptions through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• Access to premium features continues until subscription expires
• Previously earned credits remain available after downgrading

8. User Conduct and Prohibited Activities

8.1 Acceptable Use

You agree to use PrizeTrail only for lawful purposes and in accordance with these Terms.

8.2 Prohibited Activities

You may not:

• Use automated scripts, bots, or devices to artificially generate steps
• Attempt to hack, reverse engineer, or circumvent app security measures
• Share account credentials or allow others to use your account
• Create multiple accounts to exploit rewards, tournaments, or features
• Interfere with the proper functioning of the Service
• Attempt to earn step points or credits through fraudulent means
• Manipulate tournament, leaderboard, or quest results
• Collude with other users to manipulate competitive features
• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, or harm other users through any feature of the Service

8.3 Content Standards

Any content you submit through the Service, including display names and profile information, must not:

• Contain offensive, inappropriate, or harmful material
• Violate intellectual property rights
• Include personal information of others without consent
• Contain malware, viruses, or malicious code
• Impersonate other individuals or entities
• Contain hate speech, discriminatory content, or harassment

9. Intellectual Property Rights

9.1 Our Rights

The PrizeTrail app, including the PrizeTrail Watch app, and all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9.3 User Content

You retain ownership of any content you create or submit through the Service, but grant us a license to use such content for Service operation and improvement.

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our privacy practices.

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

11.2 No Guarantee of Availability

We do not guarantee that the Service will be available at all times or free from interruptions, errors, or technical issues.

11.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11.4 Health-Related Disclaimers

We are not responsible for any injuries, health issues, or adverse effects resulting from your use of the App or participation in physical activities.

11.5 Competitive Features Disclaimer

We are not responsible for any losses, including entry fees, resulting from tournament cancellations, technical issues, or disputes regarding competitive features such as tournaments, leaderboards, or quests.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

13.1 Termination by You

You may terminate your account at any time by deleting the App and contacting customer support.

13.2 Termination by Us

We may terminate or suspend your account immediately if you violate these Terms or engage in prohibited activities.

13.3 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• Your account data may be deleted
• Accumulated credits will be forfeited
• Accumulated step points will be forfeited
• Outstanding reward redemptions may be cancelled
• Tournament entries and progress will be forfeited
• Quest progress will be lost
• Streak progress will be reset
• Leaderboard entries will be removed

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through any of the following:

• In-app notifications
• Announcement banners within the app
• Email notifications
• Prominent notice in the App

Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Texas, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the arbitration group of our choosing.

15.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as part of a class action.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

19. App Store Compliance

19.1 Apple App Store

If you downloaded PrizeTrail from the Apple App Store, you acknowledge that:

• Apple is not a party to these Terms
• Apple is not responsible for the Service or any claims related to it
• Apple's terms and conditions also apply to your use of the App

19.2 Google Play Store

If you downloaded PrizeTrail from Google Play, you acknowledge that Google's terms of service also apply to your use of the App.
